Hero dog saves baby from kidnapping, family says

A kidnapping attempt was thwarted in Indianapolis on Tuesday when a family's dog stopped an armed would-be kidnapper from leaving the family's home.

Police say a man and a woman broke into the home of Nayeli Garzon-Jimenez through the back door while her husband was at work. Garzon-Jimenez was on the phone with her husband, Adolfo Angeles-Morales, at the time of the break-in.

"She started screaming and crying, and said, 'Someone just stuck their hand in the door,'" Angeles-Morales told WISH-TV. "The guy said, 'Give me the money or we take the baby.'"

"The man said, 'Money, money,'" Garzon-Jimenez said. "I said, 'I don't have any.'"

The woman then grabbed her 3-month-old girl and attempted to flee through the back door.

"But there was something else waiting for her at the back door," WISH-TV reported.

"One of the doggies," a pit bull mix, "didn't let her go through the back door," Angeles-Morales explained.

The woman turned around, "threw the baby back" at Garzon-Jimenez and the perpetrators fled the scene.

The mother, who was hit in the head with a gun during the melee, was treated for cuts and bruises at a local hospital, and was released. The baby was unharmed.

Indianapolis police are now searching for the suspects: "a black man around 35 years old, 6-foot-2, heavy set with light skin, a close-cut beard and acne scars" and "a black woman in her mid-20s about 5-foot-10, heavy build with braided hair pulled back in a ponytail" and "two lip piercings and an eyebrow piercing."

They were driving "a 2002-2007 chocolate-brown van with tinted windows and windows that extend down the passenger side."

There might be a dent in the passenger-side door, police added.

The Israeli government on Sunday admitted it had become the victim of a mass cyber-warfare campaign with millions of attempts to hack state websites since the start of its Gaza offensive four days ago.

Speaking ahead of the weekly cabinet meeting, Israeli Finance Minister Yuval Steinitz said the government was now waging war on "a second front -- of cyber attacks against Israel."

Steinitz said in the past four days, Israel had "deflected 44 million cyber attacks on government websites. All the attacks were thwarted except for one, which targeted a specific website that was down for six or seven minutes."

His remarks came a day after the online activist group Anonymous claimed to have downed dozens of websites of Israeli state agencies and a top bank in protest over the Jewish state's deadly air assault.

It also comes as both Israel and the Palestinians try exploiting the social networks in a furious effort to win over public opinion amid the worst outbreak of Middle East violence in four years.

Steinitz did not say who was responsible, but said the government had successfully managed to deflect almost every attack, thereby avoiding serious disruption or other damage.

On Saturday, Anonymous claimed to have downed or erased the databases of nearly 700 Israeli private and public websites, including that of the Bank of Jerusalem finance house.

It also claimed to have briefly downed the foreign ministry website in protest over an alleged Israeli threat to cut the Gaza Strip's Internet communications.

"For far too long, Anonymous has stood by with the rest of the world and watched in despair the barbaric, brutal and despicable treatment of the Palestinian people in the so called 'Occupied Territories' by the Israel Defence Force," Anonymous said in a statement.

"But when the government of Israel publicly threatened to sever all Internet and other telecommunications into and out of Gaza they crossed a line in the sand."

Steinitz made no direct reference to Anonymous and failed to specify if the government was dealing with a coordinated attack. He also refused to disclose which countries these efforts were being conducted from.

But the minister stressed that the government had come up with backup for "essential websites" should they be taken down.

"This is an unprecedented attack, and our success has been greater than we anticipated," Steinitz said.

Shortwave Central: Australian Radio Ships in the Pacific

Back during the concentrated events in the Pacific in the middle of last century, there was a whole host of radio ships on the air with varying forms of local and international radio communication.? The Americans used somewhere around 50 different vessels as radio communication ships over a period of time, and the Australians used a dozen or more.?
??????????? In fact, as far as some of these radio ships were concerned, it was sometimes not clear as to whether a particular ship was American or Australian.? Some ships were constructed in the United States and loaded with equipment & personnel in Australia, whereas other ships were Australian made and commandeered by the Americans.
??????????? Anyway, let?s take a look now at a cluster of these radio ships, all of which might be considered as Australian ships.
??????????? The good ship ?Harold? was built at Bermagui on the east coast of Australia in the year 1900; and 42 years later, it was commandeered for use as a radio communication ship.? This ship was also fitted with AWA electronic equipment and it is described as Australia?s 1st radio ship in the American army in the Pacific.? The ?Harold? was replaced in mid 1944 by 3 American ships in the PCER series that contained improved radio equipment, it was then taken into transportation usage, and afterwards simply abandoned at the end of the same year.?
??????????? The ?Argosy Lemal? was built in Holland in 1917, and it had half a dozen different owners, and 5 different names.? In 1933, it was operating in Australian waters with an Australian callsign, VJDF.? The ship was commandeered for wartime service in 1943, and it was quickly fitted out with an AWA transmitter and other electronic equipment.
??????????? The ?Argosy Lemal? is described as the 2nd Australian radio ship, though it was listed as the 6th small ship taken over by the Americans for radio communication service in the Pacific.? This ship was intended to provide radio communication between forward areas & American regional headquarters, and it served in localities around the New Guinea area.??
??????????? However, in the spring of the year 1944, the ?Argosy Lemal? ran aground and it was towed to Port Moresby for repair.? At this stage, this ship was also replaced by the PCER ships with their improved radio equipment in mid 1944, and so it was taken into transportation usage.?
??????????? However, 30 years later, the ?Argosy Lemal? sank in the wide Darwin Harbour during the disastrous Cyclone Tracy, that also disabled the Radio Australia relay station on Cox Peninsula.? This ship was unintentionally refound in 2003 by local divers, and it is now a declared Heritage Site.
??????????? The American Seaborne Communications Unit was organized by General Douglas MacArthur in Brisbane, Australia, early in the year 1944 and it was made up of nearly a dozen small radio ships. Among these small radio ships was a cluster of 7, all of which were built in Sydney, New South Wales, and they were all engineless and had to be towed to each operating location.
??????????? ?These 7 ships in the Ocean Lighter series, were identified alpha-numerically, as OL22, OL23, OL24, and consecutively up to OL31, though for 2 of them, the numbers have been lost.? Four of these OL ships were fitted out as one large radio station, with 2 as transmitter ships and 2 as receiver ships.????They were all equipped with AWA radio equipment, with antennas on the ships, though at times large rhombic antennas were erected on nearby shore areas.? Low power VHF links provided inter-ship communication.
??????????? One of these Ocean Lighters served as a radio repair ship, and another as a supply ship with its cargo of spare electronic equipment and many different items for personnel needs.? All 7 of the OL ships served in the Philippines, and they were all subsequently towed to Japan.
??????????? The ?Weeroona? was a side paddle wheel ship built in Scotland in 1910 for use as a luxury pleasure cruise ship in Australian waters.? Some 32 years later, the ?Weeroona? was purchased by the United States navy and fitted out as an accommodation ship for the personnel serving with the 7 Ocean Lighter series of radio communication ships.
??????????? ? The ?Weeroona? was towed to the Philippines at the totally slow rate of 4 miles an hour and even less, and it served alongside the Ocean Lighter ships.? In 1945, the Americans sold this accommodation ship to the Australian government and it was towed back to Sydney Harbour in Australia where it languished unattended for 6 more years, before it was finally dismantled.

Emotional disconnection disorder threatens marriages, researcher says

ScienceDaily (Nov. 12, 2012) ? Communication can be challenging for any married couple, but a personality trait called alexithymia that keeps people from sharing or even understanding their own emotions can further impede marital bliss. University of Missouri interpersonal communication researchers found when one spouse suffers from alexithymia, the partners can experience loneliness and a lack of intimate communication that lead to poor marital quality.

Nick Frye-Cox, a doctoral student in the Department of Human Development and Family Studies, says people with alexithymia can describe their physiological responses to events, such as sweaty palms or faster heartbeats, but are unable to identify their emotions as sad, happy or angry. In addition, those with alexithymia have difficulty discerning the causes of their feelings or explaining variations in their emotions, he said.

"People with alexithymia have trouble relating to others and tend to become uncomfortable during conversations," Frye-Cox said. "The typical alexithymic person is incredibly stoic. They like to avoid emotional topics and focus more on concrete, objective statements."

People with alexithymia avoid forming relationships; however, they get married because they still feel the basic human need to belong, which is just as fundamental as the need to eat or sleep, Frye-Cox said.

"Once they are married, alexithymic people are likely to feel lonely and have difficulty communicating intimately, which appears to be related to lower marital quality," Frye-Cox said. "People with alexithymia are always weighing the costs and benefits, so they can easily enter and exit relationships. They don't think others can meet their needs, nor do they try to meet the needs of others."

Frye-Cox collected data from both spouses in 155 heterosexual couples. He says the proportion of alexithymic people in his sample, 7.5 percent of men and 6.5 percent of women, is representative of the general population, according to previous research. The trait is often found with other conditions on the autism spectrum, as well as with post-traumatic stress disorders. Studies also have shown that alexithymia has been related to eating and panic disorders, substance abuse and depression.

The study, "Alexithymia and marital quality: The mediating roles of loneliness and intimate communication," will be published in the Journal of Family Psychology. In his previous research, co-author Colin Hesse, an assistant professor in the Department of Communication, found that affectionate communication, such as hugging or touching, could help those who have high levels of alexithymia lead more fulfilling lives.

Bernanke's successor could have hands tied

President Barack Obama's next choice to head the U.S. Federal Reserve could have his or her hands tied if Ben Bernanke and company continue to re-write the policymaking rule book at their current clip.

Under Chairman Bernanke, who is expected to step down when his current term expires in January 2014, the U.S. central bank has embraced the goal of making the historically shrouded business of setting monetary policy far more transparent.

It has adopted a string of new rules and guidelines to clarify its policy intentions, including an inflation target and a conditional vow to hold interest rates near zero until at least mid-2015.

The next step is being hotly debated now.

Fed policymakers are striving to agree on a set of economic variables, or thresholds -- probably particular levels of unemployment and inflation -- that would signal when the time to raise interest rates was finally drawing near.

The trick is making a credible commitment that convinces investors to keep longer-term borrowing costs low, thus stimulating the economy, while at the same time ensuring the Fed can react swiftly to changing economic realities.

The concern is that these rules and guidelines will crimp the central bank's flexibility in years to come as it deals with the fits and starts of a protracted U.S. economic recovery.

"The more they do it over the next year, the more the next chair will be constrained," said Vincent Reinhart, chief U.S. economist at Morgan Stanley and a former Fed economist. The "constructive ambiguity" the central bank has famously used over the years to safeguard its policy-setting discretion is slowly disappearing, he said.

Preserving policy credibility
In battling the worst recession in decades, central banks around the world have deployed untested tools, such as large-scale bond purchases. They have also often made commitments about how, and for how long, they plan to use the tools.

Their decisions will matter for years to come.

After eight grueling years battling a severe financial crisis, the deepest recession since the Great Depression and a disappointing recovery, Fed watchers say Bernanke will likely want to step down when his second term as Fed chief expires, even if Obama wants him to stay.

But the economy is unlikely to have fully recovered by then, leaving any rate-hike cycle to his successor. Fed Vice Chair Janet Yellen and Lawrence Summers, a former White House economic adviser, are both considered possible top candidates for the job.

Whomever Obama nominates will be handed a rule book from the Bernanke era that will be difficult, and maybe unwise, to erase.

Though the guidelines adopted under Bernanke are not iron-clad law, "the credibility of policy actions would be at stake if they were easily overturned," said Peter Hooper, chief U.S. economist at Deutsche Bank Securities.

Age of improv
If Fed officials can reach agreement, economic thresholds would replace their stated expectation that interest rates would remain near zero through at least mid-2015.

It would be the latest refinement to the Fed's communications toolkit. In the last 16 months alone, it moved to tie low interest rates to calendar dates, adopted a formal inflation target of 2 percent, and published the policy expectations of each of its 19 policymakers. It built on that list in September when it said it expected to buy bonds until the labor market outlook improved "substantially."

Within the Fed's policy-making committee, however, consensus on which unemployment or inflation levels to use has proven elusive. Four top Fed officials have gone public with their own proposals, whether simply to provide a window into their tough internal debate or to sway their colleagues.

"It would be nice if we could communicate more clearly what those parameters are," William Dudley, the influential president of the Federal Reserve Bank of New York, said last month.

"The problem of course is that it's very hard to summarize the economy, and how you're going to feel about the economy, through just one or two parameters," said Dudley, who has not pitched a plan.

Yellen -- who as chair would likely smooth the transition from Bernanke -- could shed more light on the issue on Tuesday when she gives a speech on central bank communications.

To be sure, Bernanke's Fed has been careful to leave itself some breathing space. The current round of bond purchases is "open-ended," meaning there is no dollar value or timeline constraining it.

Still, the drum beat of rule changes continues.

The Fed is also considering adopting a "consensus forecast" to give investors a better sense of how policy is likely to evolve. That would build on a January decision to publish for the first time individual policymakers' rates forecasts.

As Bernanke's term draws to a close, the jury is still out on the effectiveness of the new transparency steps.

"It is the improvisation stage," Reinhart said, "and it does feel unsatisfying."

The normalization of Apple

There's been a lot of great stuff written about the recent Apple management shake-up that saw Scott Forstall removed as head of iOS and his portfolio re-distributed to Jony Ive (design), Craig Frederighi (software), and Eddy Cue (services).

That last one in particular, by Michael Lopp, talks to the important of disruption is vital to success.

The word that worried me the most in the press release was in the first sentence. The word was ?collaboration?. Close your eyes and imagine a meeting with Steve Jobs. Imagine how it proceeds and how decisions are made. Does the word collaboration ever enter your mind? Not mine. I?m just sitting there on pins and needles waiting for the guy to explode and rip us to shreds because we phoned it in on a seemingly unimportant icon.

Consensus is said to be the opposite of leadership, but collaboration is a tool to achieve normalization. Under Steve Jobs, the power of personality literally revolutionized the consumer electronic world. Under Scott Forstall, the power of personality literally changed the mobile experience of a generation. Yet with incredible highs come incredible lows. Success, like everything, has a price. And that price is equal and opposite failure. MobileMe, iOS 6 Maps, Siri reliability -- the list is well known.

Absent Steve Jobs, and now absent Scott Forstall, we may have lost Apple's highest highs and the greatest greats. But we may also have lost the lowest lows and worst of the worsts that came with them. Instead of Star Wars under Lucas, we'll have Star Wars under Disney. Instead of Kubrick, we'll have Pixar.

Just like Steve Jobs did with product grids, Tim Cook has now done with people. There will still be great things, and still be terrible things, but the chances of both will be lessened by collaboration and committee.

Asian stocks fall on US economy fears

BANGKOK (AP) ? Uncertainty over whether Washington will be able to work out a spending and taxation deal that is crucial to keeping the U.S. economic recovery on track caused Asian stock markets to stall Monday.

Economists have said the U.S. risks slipping into recession if hundreds of billions of dollars in expiring tax cuts and automatic spending reductions take effect on Jan. 1 ? the so called "fiscal cliff." Congress and the White House must find a compromise to prevent a big hit to the world's biggest economy.

President Barack Obama, fresh from a re-election victory, and House Speaker John Boehner have spoken of compromise but appear to be taking firm stances on some issues, including whether to raise taxes for the wealthiest Americans.

"Despite comments from the US administration and Congressional leaders of a willingness to compromise, markets remain unconvinced," analysts at Credit Agricole CIB in Hong Kong said in a market commentary.

Japan's Nikkei 225 index fell 0.6 percent to 8,704.21, with growth figures showing the economy contracted an annualized 3.5 percent for the quarter ending September. Most economists forecast a further decline in economic activity for the October-December quarter, which would officially put the world's No. 3 economy in recession, according to the common definition of two consecutive quarters of contraction.

South Korea's Kospi fell 0.2 percent to 1,900.27 and Australia's S&P/ASX 200 lost 0.2 percent to 4,453.40. Benchmarks in Singapore, Taiwan and Indonesia fell. The Philippines and New Zealand rose.

Hong Kong and mainland Chinese stock markets rose following comments over the weekend by Chinese Cabinet officials that the country's economic slowdown has ended, although the economy is not ready to stage a recovery, and that exporters still face tough conditions.

Hong Kong's Hang Seng added 0.2 percent to 21,421.44. The Shanghai Composite Index gained 0.1 percent to 2,071.80 and the smaller Shenzhen Composite Index added 0.4 percent to 831.58.

Jackson Wong, vice president at Tanrich Securities in Hong Kong, cautioned against too much optimism regarding China's economy amid disappointing Chinese loan growth figures.

Lending in October stood at 505.2 billion yuan ($80.3 billion), dropping 81.6 billion yuan from a year earlier, the People's Bank of China said Monday, according to Xinhua news agency. The figure decreased from the 623.2 billion yuan of new yuan loans registered in September.

"Expect light trading this week unless major news comes out," Wong said.

Among individual stocks, Suzuki Motor Corp. enjoyed a 5.1 percent jump. The company reported a 30.9 percent rise in April-September consolidated net profit reported Friday.

Australia's QBE Insurance Group, which said it expects losses from superstorm Sandy in the U.S. to be up to $450 million, tumbled 8.2 percent.

Wall Street stocks began a slide Wednesday in the biggest sell-off of the year after Obama won re-election. Then investors immediately turned to worrying about the looming fiscal crunch.

On Friday, the Dow Jones industrial average rose marginally to 12,815.39. The Standard & Poor's 500 rose 0.2 percent to 1,379.85. The Nasdaq composite rose 0.3 percent to 2,904.87.

Benchmark oil for December delivery rose 2 cents to $86.09 in electronic trading on the New York Mercantile Exchange. The contract rose 98 cents to finish at $86.07 per barrel on the Nymex on Friday.

In currencies, the euro rose to $1.2729 from $1.2713 late Friday in New York. The dollar strengthened slightly to 79.47 yen from 79.45 yen.

To have a successful career and life one must have a philosophy. You can?t do everything well, so you must have a sound belief system in place as your foundation. The foundation of any great sports program or business is the philosophy. This week I will share with you my basic philosophy for a sports program. I am confident this can be transferred to the business world and allow you to be successful as well.

A large influence in my teaching and coaching life has been my uncle, Charlie Elmendorf. He has been in education and coaching for close to 30 years. I was fortunate to have him as my football coach in high school.

Analysis: Manning plea offer in WikiLeaks case carries risk, reward

NEW YORK (Reuters) - An offer of a partial plea by the U.S. Army private accused of leaking documents to WikiLeaks appears to be a two-pronged defense strategy that seeks to win sympathy from the judge and to shift the focus of the trial to charges that are more difficult to prove, legal experts said.

The offer from the accused private, Bradley Manning, was made public late Wednesday by his attorney, who indicated in a blog post that his client was willing to plead guilty to less serious offenses than those charged by prosecutors while contesting the other accusations in court.

The so-called naked plea is a rarely used tactic employed in military court proceedings and would only have to be accepted by the judge overseeing the case. It does not require consent from prosecutors who have brought 22 charges against Manning in what has been described as the largest leak of classified government documents in history.

Manning is accused of passing the documents to WikiLeaks, the online whistleblowing site founded by Australian Internet activist Julian Assange. WikiLeaks has never confirmed that Manning was the source of any documents it released.

Among other charges, Manning is accused of unauthorized possession of information related to national defense and stealing records belonging to the United States.

In his blog post, Manning's lawyer, David Coombs, wrote that his client is "attempting to accept responsibility for offences that are encapsulated within, or are a subset of, the charged offenses." This process is known as pleading by exceptions and substitutions.

Coombs did not respond to messages seeking comment.

The plea tactic seems aimed at achieving two goals, legal experts said.

First, it is seen as an attempt by Manning to curry favor with the judge in a bid for a more lenient sentence. Under this theory, Manning hopes the judge will go easy on him for acknowledging actions he would not be able to refute at trial, said Victor Hansen, a former military lawyer and a professor at New England Law School.

"He can say ?I manned up to what I did,'" said Hansen.

HIGH BAR

At the same time, Manning could be trying to pare down the prosecution's case to the most difficult charges to prove, including accusations that he intended to aid the enemy - in this case, al Qaeda.

Proving that Manning intended to aid the enemy could require prosecutors to establish that Manning wanted the leaked information to reach al Qaeda, and that is a high legal bar, said David Velloney, a military law expert who is a professor at the Regent University School of Law.

"He's looking to fight the case in the most tactically favorable way and in the light most favorable to him," said Velloney.

But there are dangers in Manning's strategy. Even if the judge accepts the deal, there is no guarantee that Manning will be credited for pleading guilty to certain offenses in this late stage of the case.

By pleading guilty to certain facts, Manning also gives up any right to contest them at trial, which could make it easier for the government to prove its most serious charges.

"That's the cost-benefit analysis you have to do," said Philip Cave, a military law expert in private practice.

WikiLeaks founder Assange faces extradition to Sweden from Britain for questioning in a sexual molestation case. He has taken refuge in the Ecuadorean Embassy in London.

Assange and his supporters have said the Swedish case against him could be part of a secret plot to have him shipped for trial to the United States and either executed or imprisoned at the U.S. detention facility in Guantanamo Bay, Cuba.

U.S. officials have denied those assertions. But they have acknowledged that a federal grand jury in Alexandria, Virginia, has been collecting evidence about WikiLeaks and some of its activists. Officials have not ruled out U.S. criminal charges against Assange.

Think about how often you use the internet. Seriously, just think about it for a second. I?m willing to bet that the vast majority of people would severely underestimate their dependence. Sure, maybe you don?t really get on Facebook or Twitter all that often. Maybe you?re not an online gamer. But when?s the last time you sent an email? Looked up a restaurant or used online maps? Hell, when?s the last time you Googled something?

Of course, I?m making a silly argument. Everyone knows that the internet has become an indelible part of everyday life for most people. But would you go so far as to say that access to the internet and social media has become an unalienable right? One that if restricted, violates the constitution?

If you answered yes to that, let?s tack on another layer. Would you still say it was a right for some of the worst criminal offenders imaginable? Those guilty of sex crimes? How about another layer. What if the criminal in question was a minor? Let us know in the comments.

A California Appellate judge has ruled that the probation conditions of a 15-year-old boy that barred him from accessing a computer in non-academic settings and disallowed any participation in social media are invalid. The 15-year old offender was found to have sexually assaulted two girls, a 13-year-old and a 2-year-old.

The minor and his lawyers had challenged some of the terms of his probation, including a ban on using computers with encryption, cracking, keystroke monitoring, security testing, etc. He also challenged the ban on maintaing a social media page and using chat rooms and instant messaging software. Finally, he took issue with being barred from using a computer for any purpose other the school-related assignments.

First, a little background on his crimes.

The minor, only identified as Andre B., was found to have sexually assaulted two individuals on separate occasions. His first victim was a 13-year-old middle school student who claimed that Andre held her down and ?grinded his pelvis on her? for about 30 seconds. The other victim was a two-and-a-half-year-old girl whose vagina was ?touched and possibly penetrated? by the defendant. Terrible crimes, of course. But the specifics aren?t important except for the fact that neither crime involved the internet in any way (according to the court).

In the opinion, Judge Terry O?Rourke notes that Andre?s contentions lean on a 1975 case that determined how probation conditions could be held invalid if they have no ties to the actual crime committed.

?A condition of probation will not be held invalid unless it ?(1) has no relationship to the crime of which the offender was convicted, (2) relates to conduct which is not in itself criminal, and (3) requires or forbids conduct which is not reasonably related to future criminality?Conversely, a condition of probation which requires or forbids conduct which is not itself criminal is valid if that conduct is reasonably related to the crime of which the defendant was convicted or to future criminality.?

He also cites a 2003 ruling that discusses how outright internet bans on probationers and parolees have been struck down in both state and federal courts.

?[S]uch a ban renders modern life?in which, for example, the government strongly encourages taxpayers to file their returns electronically, where more and more commerce is conducted on-line, and where vast amounts of government information are communicated via website?exceptionally difficult.?

O?Rourke?s opinion is that a blanket internet ban is invalid because it?s not closely tied to past crimes or future criminality.

?They are not tailored to Andre?s convictions for violating another?s personal liberty, willfully annoying and molesting another, unlawful use of force, and lewd and lascivious conduct, or the juvenile court?s dual goals of rehabilitation and public safety,? he says.

As far as the ban on social media accounts, the logic is similar (but with a caveat):

There is no evidence or indication in the record that Andre used Internet chat rooms or social media to contact his victims or to learn how to carry out his actions underlying the true findings. We conclude that prohibiting Andre from using social media is overbroad and, as phrased, the prohibition has no bearing on his possible rehabilitation.

At oral argument, defense counsel conceded that in light of the fact a minor?s constitutional rights are circumscribed, the probation terms prohibiting him from having or using social media accounts can be more narrowly tailored to fit his sexual crimes and foster his rehabilitation. Accordingly, we remand for the trial court to narrowly tailor the probation terms banning him from having or using ?a MySpace page, a Facebook page, or any other similar page,? and from ?participating in chat rooms, using instant messaging such as ICQ, MySpace, Facebook, TWITTER, or other similar communication programs.?

In short, an outright ban on social media use is overbroad, but certain restrictions could be possible if they could be shown to pertain to his specific crimes and help in his rehabilitation.

Andre didn?t challenge the condition that he be barred from accessing porn online, but he did challenge the ban on ? knowingly using ?a computer that contains any encryption, hacking, cracking, keystroke monitoring, security testing, or steganography, Trojan or virus software.?? The Judge upheld that condition, saying that it is reasonable because it allows probation officers to monitor his compliance with the no-porn clause.

So ? blanket computer bans and social media bans are a tricky prospect. Of course, any parents acknowledges that the internet can be a dangerous place for their kids ? and the visceral reaction is to want any sex offender (no matter the age) banned from using the internet as his scouting grounds.

But has the internet become so important to functioning, day to day, in modern society that restricting access amounts to a violation of rights?

Earlier this year, we told you about a wave of challenges to state laws banning sex offenders? use of social media, spearheaded by civil right groups like the ACLU.

Many states, including Indiana and Louisiana have passed legislation that makes accessing Facebook, Twitter or the like a crime for convicted sex offenders. In Louisiana, a Judge ruled such a law ?unconstitutionally overbroad? (recognize that phrase?), saying:

Although the act is intended to promote the legitimate and compelling state interest of protecting minors from internet predators, the near total ban on internet access imposed by the act unreasonably restricts many ordinary activities that have become important to everyday life in today?s world. The sweeping restrictions on the use of the internet for purposes completely unrelated to the activities sought to be banned by the Act impose severe and unwarranted restraints on constitutionally protected speech. More focused restriction that are narrowly tailored to address the specific conduct sought to be proscribed should be pursued.

Some agree:

?To broadly prohibit such a large group of persons from ever using these modern forms of communication is just something the First Amendment cannot tolerate,? said the ACLU?s Ken Falk in response to such measures.

In our featured case, Andre didn?t use the internet to stalk his victims. The Judge saw that, and said that the punishment didn?t fit the crime. But of course, one of a sexual predator?s biggest tools is the internet. For those concerned about the protection of kids online, it doesn?t seem that out of the realm of possibility to cut his rights to it altogether.

Then again, he?s 15. And over the next (8, at the maximum) years, a ban on non-academic computer use and social media use would cripple his ability to do so many things in modern society. Online Math Textbooks Rankle Teachers, Parents - Burke, VA Patch

Shortly after the start of the school year in September, Kirsten Rucker had scheduled an X-ray appointment for one of her twin sons ? both juniors at Oakton High School ? after class.

But when she asked him to bring his homework while they waited for the doctor he said he couldn't. It was all online. ?

She thought they would find a way to bring it with them. She found quickly she was wrong.?

They could access the material, but couldn't print pages. They tried to copy and paste from a PDF file, but were blocked by the software. They pulled up a print screen, but the words ran together, jumbled across the page. It wouldn't load on a reader, or an iPhone.

They went to the appointment empty handed, and when her son returned late that evening, he worked even later into the night grappling with the system trying to finish his assignment. Rucker said he discovered ? that night and in the weeks since ? there was no search function to locate subjects in the text, no index for the answer guide.? It was hard to keep track of complex equations glancing between his worksheet and the screen.

The experience is one shared by a growing number of Fairfax County Public Schools students, their parents and teachers say, as the system makes the jump to an online textbook program in mathematics this year.

The system already has in place online programs for foreign language and social studies, but the switch to online math textbooks was different: Unlike its predecessors, the online math initiative had no pilot program ? the success of the online social studies pilot left FCPS feeling like "it was ready to move forward," school officials said.

But parents, teachers, and school board members made clear this week ? in PTA meetings, school board forums, mass emails and letters to administrators ?? that the program is instead pushing achievement and learning back, calling the initiative "a big disaster" with no clear solutions; a "domino"?like tumble of one issue after the next.

Some board members said Thursday they were concerned not only about ?the immediate technology, access, communication, equity and financial issues the program has created, and how it will affect scores on a new and challenging math SOL, but in a broader context, how the board can prevent decisions like this ? made largely without teacher buy-in or informed board discussion ? from happening again.

"It's a far more complicated issue than a simple math textbook adoption and I don?t think this was a fully informed, vetted decision. This wasn't piloted. The school system didn't realize they made the mistakes we now face ... and if we don't understand the mistakes that got made before we could repeat the process again," said school board member Megan McLaughlin (Braddock), who asked the board Thursday to schedule a December work session on the issue.

"This isn't the first time that we've had an issue like this," member Patty Reed (Providence) said.

'It Just Kind of Came Out of the Clear Blue'?

In the 2010-11 school year, the system launched a pilot for a social studies online textbook program, FCPS spokesman John Torre said. It involved 7,937 students and 113 teachers in seventh grade history and high school government classes, across eight middle schools and 10 high schools.

Based on that program's success, the system decided to bring online textbooks for all core social studies classes in grades seven to 12 the following year, with a contract that included online subscriptions and some text copies available to students during and after school, Torre said.

The system "hadn't purchased new math textbooks in more than 12 years," Torre said, so when the system was due to purchase them this year, they proposed going online. The board authorized the $7.7 million purchase this summer, after the fiscal year 2013 budget was accepted. Unlike the social studies program, the online math textbooks were purchased for students grades k through 12 across the county.

"It was done much too quickly," said Reed, who voted against the purchase. "I had reservations right from the beginning about why all the sudden did we need to do this. It wasn't discussed in the context of the budget deliberations [that spring]. It just kind of came out of the clear blue."

One teachers union says the decision went against a recommendation rejecting a proposal for the program and a specific request from educators to hold off on implementing any new initiatives ? they were already overloaded, they said, with a new teacher evaluation system and changing standards for several state Standard of Learning subject tests.

"What they ended up doing was exactly the opposite of what we asked them to do," said Steve Greenburg, president of the Fairfax County Federation of Teachers. "I get the impression that we?re completely ignored half the time."

The 2012 FCFT Member Perspectives Survey, taken by more than 450 members between Oct. 16 and Nov. 2 , shows many respondents think not only was the timing "terrible," but some of the material, training and much of the interface is terrible too.

"We were shown the online textbook a week before school opened," one teacher wrote. "We didn't get a hard copy of the new textbook til much later as well."

Torre said demo accounts were available for teachers in April.

Some teachers have abandoned the book altogether and are creating lesson plans from other materials.

How many times that has happened and where is not clear, though Torre noted schools could not opt out of the textbooks. Reed asked for that kind of data before the board discusses the issue in December.

"I have 24 students and only received 5 textbooks and was told I was not getting anymore. I do not have enough access to technology and therefore have to print everything. I have students who have no access at home and I don't have enough books for them to borrow," wrote one teacher in the survey.

Another wrote of a concern the school system hops from trend to trend "without much closure from one to the next."

"It is like people are trying to justify their jobs by creating and pushing certain agendas into the trenches where the teachers are actually working with the TRUE customer which is the students," the teacher continued. "Seems like a lot of top down management decisions are made with no regard for the foot soldiers (teachers) and how they have to SURVIVE each day with the LATEST and GREATEST trend pushed by someone that does not even teach/interact with students. Can we get used to and perfect things that are working well before we change it all up again? Or can we use the new stuff to enhance the current stuff instead of starting over?"

Limited Access to Hard Copies

Hard copy books are available for check out by students, Torre said, but parents and school board members are saying that is not enough. Not all students can stay after class to check out the books because of sports, clubs, activities, doctors' appointments and transportation issues. Some principals have used their discretionary funds to purchase hard copy books for some classes, Rucker said. Some parents have paid out of pocket so their children can use a book in class and at home; Madison High School sold hard copies of some books at its back to school night this year, Rucker said.

Sixty-two percent of teachers who responded to FCFT's survey said they don't have enough textbooks to accommodate students' needs.

At a more basic level, accessing the material at all is an even larger problem for students in high poverty areas.

"A large portion of my students lack the technology at home to access anything online, let alone a math textbook," one teacher wrote.

And parents and schools in that area cannot afford to supplement with hard copies the way schools in more affluent communities can, Rucker said.

"It's the same old, Have's and Have Not's problem,? one teachers said.

FCPS is now considering buying additional print copies to address the concerns raised about access, Torre said, also noting "students are not required to purchase or own their own computers. Students have access to school computers during the day and after school," and "... some schools have programs where students can check out computers for use at home and all students are allowed, with parental permission, to bring their own laptops or tablets to school to access online textbooks."

"We've been told we can use the mobile labs, but they are slow (more time), not always available, not always charged, difficult to get.....in other words, their own logistical hurdle and I have no time for any more problems to solve," a teacher responding to the FCFT survey wrote.

Though training for teachers began in June, Torre said, with sessions offered several times since then, some teachers said more time was needed to implement the program successfully.

"I spend too much time learning to navigate this book when trying to plan and too much time getting 'lost' as I plan and teach," a teacher responding to the FCFT survey wrote, noting they ended up printing more material to compensate for the issues with the online material.

As a result, some schools have been burning through paper much more quickly; Rucker, Oakton High School's PTA president, said the building ran out of paper for October by the 10th?of the month.

On Thursday, Superintendent Jack Dale told the board he and staff would put together some solutions before a December work session discussion on the issue, to fast-track changes.

When Dale mentioned conducting community engagement, Elizabeth Schultz (Springfield) thought the board needed a public hearing to fully engage all stakeholders on the issue.

Reed said she would like to hold the publishers more accountable for links that are broken and materials that are not performing, noting if they are not delivering services outline in a contract then the system should explore holding payment or cutting the contract until they do, if possible.

Rucker, who led discussion among 40 parents at a PTA meeting organized around the issue Wednesday night and is planning a broader discussion among county high school PTA leaders Nov. 15, said the response she has gotten from system administrators has been one of concern and willingness to work through the issue. But the system needs to act fast, she said.

"I think this is a learning experience. It was a tremendous failure but we don't want to lose the year," Rucker said. "I think the school system needs to react quickly to make sure we don't lose time. We are a community and we are in this together and whether or not they went about that the wrong way, my interest is what we can do going forward.?
